These contractual terms and conditions are articulated according to the following paragraphs:

  1. Purpose and object of the contract

On this website it is possible to purchase the products offered for sale according to these conditions, availability, guarantees and methods, taking into account the characteristics and peculiarities of the product purchased.

In particular, the following products can be purchased in the specific section:

  • honey
  • nuclei
  • packs of bees
  • live queen bees

The goods offered for sale are directly produced by the seller, who ensures their authenticity, the conformity of the detailed characteristics in the data sheets of each individual product and reserves their ownership until the actual payment of the purchased goods.

It is specified that the seller can highlight on the website dedicated to the sale minimum purchase quantities, also in relation to the destination of the product.

For sales made abroad, the health certification (TRACES) required for shipping outside the National Borders is produced by the seller with costs borne by the Buyer.

  1. Order and purchase methods 

The Purchaser will be able to choose the products to be purchased by browsing or searching for the products available through the search functions. By clicking on the "Buy" button relating to the desired product, it will be added to the virtual cart and can continue with the purchases or you can click on "View Cart" to check the total quantity of purchases made and proceed directly to finalize the purchase. 

In this phase it will be possible to increase and / or decrease the quantities of the chosen product, empty the trolley or add other products. Once the insertion of the products in the cart is complete, the Purchaser will be able to proceed with the purchase.

It is specified that it will be possible to ship the products purchased throughout the national territory and abroad (European Community and other countries), under the conditions set out below.

  • Payment on delivery to the driver, in case of products delivered directly from the Seller.

The price shown is relative to each individual product and is to be understood net of VAT, shipping costs and any other supplements and cost of the health certification - TRACES - (for shipments in the European Community - Abroad).

At the time of payment, therefore, in the section dedicated to finalizing the order, the unit price of each individual product to be purchased, quantity, taxable amount, VAT amount, shipping costs, any transport insurance, and others will be highlighted. any supplements and cost of health certification - TRACES - (for shipments to the European Community - Abroad).

 

The payment due will therefore be determined by the sum of the tax base, VAT and shipping costs (and any transport and substitute insurance and health certification for shipments in the European Community - Abroad - TRACES).

  1. Order acceptance, discounts and promotions regulation, execution and conclusion of the contract;

Once payment has been made, confirmation will be given by e-mail to the buyer and the progressive order number will be communicated.

In the case of offers and promotions (including temporary ones), the percentage discount granted for each individual product is to be considered applied to the relative unit price net of VAT. The discount applied, barring errors and omissions, will be highlighted in the purchase section of the individual product.

In the case of offers, discounts and promotions to be applied to shipping costs, the discount percentage, the lower price or any gratuity will be highlighted when the order is finalized, in correspondence with the "shipping costs" item. These offers will be highlighted in advance by the seller in the home page of the website and in the product showcase, also in order to make the buyer aware of the ongoing offers and promotions that may concern each component that contributes to determining the final price and the payment due.

In case of purchase orders of large quantities, such as to require the preparation of dedicated logistic resources, the buyer can contact the seller directly, also in order to identify a method of purchase and delivery that meets the needs of the customer himself and of the capabilities of the seller.

At the time of purchase, the buyer must carefully fill out the purchase form in all its parts, including the Tax Code, any VAT number, any recipient code or PEC, and any other data useful for invoicing.

The address of the buyer will also be indicated, useful for communications exclusively aimed at completing the purchase procedure.

The delivery or collection address must be indicated. The seller will not respond in any case and for any reason in the event of erroneous, false or inaccurate communication of the billing and shipping data.

In the event of mistakes in the compiling of the data useful for billing, the Buyer must promptly notify the seller by e-mail, before the transport document and the tax document are issued, or before the shipment is executed.

No changes will be possible after the issue of the tax document.

The processing of the data provided is aimed exclusively at the purchase procedure. The rules and regulations are highlighted in the specific section on the Privacy Policy.

  1. Methods, terms and conditions of shipping and delivery

The shipment will be made by the seller's express courier. The indicative cost of each single shipment for Italy and the Islands is as follows:

Italy Zone A: Abruzzo, Basilicata, Campania, Emilia Romagna, Friuli Venezia Giulia, Lazio, Liguria, Lombardy, Marche, Molise, Piedmont, Puglia, Tuscany, Trentino Alto Adige, Umbria, Aosta Valley, Veneto.

Italy Zone B: Calabria, Sardinia, Sicily.

For the smaller islands (Lampedusa, Pantelleria, Eolie etc) the rates will be applied at the time

in force for these destinations.

To these costs, other supplements will be added based on the actual characteristics of the product, so that safe transport is ensured (special oversize packaging, etc).

It is specified that the shipping costs shown are purely indicative: they may undergo variations as per the lists made at the time of purchase by the shipper.

However, they will be highlighted on the website when the purchase is finalized.

For shipments made abroad, the rates in force at the time of purchase will be applied, implemented by the shipper based on the quality and destination of the products.

The delivery times, guaranteed directly by the shipper and the carrier, are as follows:

  • Queen bees for Italy in zones A and B and abroad 24/72 working hours;
  • Honey (Italy) 48/72 working hours;
  • Honey (Abroad) 72/96 working hours
  • The packages of bees and the nuclei will be delivered directly by the seller, it will therefore be

care of the parties by mutual agreement according to the respective needs, times and methods of delivery.

Orders will be sent for shipment within 8 hours of their processing, except for any unforeseeable events and causes of force majeure, or restrictions by the Authorities. In this sense, the seller, if the buyer has requested the tracking of the individual stages of the purchase, will receive confirmation of the acquisition of the order, processing, delivery to the shipper.

In this last phase (delivery to the shipper), the seller will communicate the order shipping code. After the shipment, the buyer will check the transit and the status of the shipment on the tracking service prepared by the Shipping and Transportation Company.

For all purposes and by law, the seller's obligations are certainly considered fulfilled at the time of delivery to the shipper.

In case of decay, as a whole or partly, of the goods purchased for reasons not directly and / or indirectly attributable to the buyer, any related dispute will be regulated according to the reference standards, in particular those expressly referred to by Legislative Decree 21 February 2014 n. 21 and the Civil Code, even in the event of exemption from the guarantee for reasons of force majeure.

Information relating to the exercise of the right of withdrawal pursuant to art.49, paragraph 4, - Legislative Decree 21 February 2014 n.21

  1. Right of withdrawal - Policy on complaints and disputes.

The Buyer has the right to withdraw from the contract, without indicating the reasons, within 14 days. The withdrawal period expires after 14 days from the day on which the Purchaser or a third party, other than the carrier and the Purchaser designated or appointed to deliver, acquires physical possession of the goods.

To exercise the right of withdrawal, the Buyer is required to inform the seller of their decision to withdraw from the contract by means of an explicit declaration (e-mail). To this end, they send an e-mail to the e-mail address info@apicolturalaterza.com or via PEC, forwarding the communication to the PEC address legal@apicolturalaterza.com, indicating in the subject: withdrawal of order no. (reporting the order number received on confirmation of receipt of the order), name and surname.

If the withdrawal is caused by errors and / or omissions of the seller, the contact center is available to the buyer to resolve, where possible, the critical issues encountered and collect reports and suggestions.

A confirmation of receipt of the withdrawal will always be sent to the buyer by e-mail.

To comply with the withdrawal deadline, it is sufficient for the Purchaser to send the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.

  1. Effects of withdrawal

If the Buyer withdraws from the contract, they will be reimbursed for the related payments made to the seller, excluding the shipping cost, without delay and in any case no later than 14 days from the day on which the seller is informed of the withdraw from the contract. These repayments will be made using the same payment method used by the Purchaser for the initial transaction, unless the same has expressly agreed otherwise; in any case, the Buyer will not incur any costs as a consequence of this refund.

In the event that the right of withdrawal is exercised after the delivery of the goods, the refund in favor of the buyer will be made once the goods have been returned to the seller. The withdrawing buyer must therefore without delay, in order for the explicit right of withdrawal to be effectively executed, proceed to return the goods purchased by the seller.

The return must be made by express courier, with delivery methods that ensure prompt availability of the goods returned to the seller, at least equal to those insured by the seller at the time of order fulfillment, the authenticity of which must be preserved and any deterioration avoided.

In any case, the withdrawal deadline is considered respected if the goods are sent back to the seller before the expiry of the 14-day period.

The costs, even indirect, of returning the goods are borne by the Buyer.

The Purchaser is only responsible for the decrease in the value of the goods resulting from a manipulation of the goods other than that necessary to establish the nature, probe, characteristics and functioning of the goods

  1. Liability for defects and product warranty policy

The products are covered by a legal guarantee pursuant to art. 128 and following of Legislative Decree 206/2005 and subsequent amendments and additions.

  1. a) shipping and delivery methods, limitations, waivers and exemptions from liability for product types:

QUEEN BEES

Due to the specific characteristics of the product, the queen bees will be shipped at the buyer's sole risk.

The seller undertakes to guarantee the strict respect of all the conditions useful to ensure the vitality of the queen bees sent, from the sorting, boxing in the accommodation and packing cells.

Being live animals, whose vitality is conditioned by unmeasurable, non-predictable and non-calculable factors, the seller will not respond in any way and for any reason and / or title in the event of total or partial perishing of the queen bees.

Our trusted shippers have experience in the transport of live queen bees, but the factors that can condition their death during transport, delivery or in the immediately following stages, are imponderable and non-predictable, not dependent on the will of the seller. The event must therefore be considered a cause of force majeure which excludes any possibility of reimbursement and / or compensation in favor of the buyer.

However, the seller will always ensure prompt assistance to the buyer also for such occurrences, through the contact center. We create queen bees of the best species and of great and tested resistance, but our work is conditioned by circumstances that do not depend on our will: in such cases, however, we will be happy to evaluate your reports.

  1. b) shipping and delivery methods, limitations, waivers and exemptions from liability for product types:

NUCLEI AND PACKS OF BEES

Due to the characteristics of the product and the logistical organization of the seller, the nuclei and parcels of bees will be ordered in the same manner as previously indicated, without prejudice to transport and delivery, which will be carried out directly by the seller.

In this sense and only for these products (nuclei), the seller also undertakes to transport up to the delivery of the products at the motorway toll booths indicated in this map:

Motorway toll booths: Castellaneta, Gioia del Colle, Acquaviva delle Fonti, Bari, Bitonto, Molfetta, Trani, Andria, Canosa di Puglia, Cerignola, Foggia, San Severo, Poggio Imperiale, Termoli, Vasto, Lanciano, Ortona, Pescara, Pineto Atri, Roseto degli Abruzzi, Giulianova, San Benedetto del Tronto, Grottammare, Pedaso, Fermo, Porto Sant'Elpidio, Civitanova Marche, Porto Recanati, Ancona, Montemarciano, Senigallia, Marotta - Mondolfo, Fano, Cattolica, Riccione, Rimini, Cesena, Forlì, Faenza, Imola, Castel San Pietro Terme, Bologna, Torino, Pesaro, Modena, Parma, Piacenza, Milano, Campogalliano, Carpi, Verona, Trento, Bolzano, Bressanone, Tortona, Alessandria, Asti, Mantua, Verona, Bolzano.

For these products, the seller will proceed directly to the delivery of the same to the Buyer.

However, it will be possible to agree on a delivery method different from that made at the toll booths, at the purchaser's home or elsewhere, if this circumstance does not cause delays in moving, in carrying out subsequent and not serious deliveries of further costs and charges.

For the delivery abroad of these products, the Seller reserves the right to contact the Buyer directly in order to agree on any order execution and delivery methods.

At the time of delivery, the buyer will ascertain the integrity and conformity of the goods directly delivered by the seller, certainly having to consider that any defect of immediate perception can be reported exclusively there.

  1. Complaints, suggestions, alternative resolution of disputes, place of jurisdiction. Reference to sector standards.

Although not expressly provided, we intend to refer to the general conditions of sale (where applicable in this case), privacy policy and legislative, regulatory and usage provisions.

For complaints, written communication can be sent by e-mail info@apicolturalaterza.com.

Each dispute must be notified by means of round trip or PEC.

In the event of disputes, there will be a tendency to favor out-of-court resolution and amicable settlement.

The jurisdiction of the Court of Taranto is identified for each activity, task and initiative in litigation. If the buyer is a consumer, please refer to the reference and sector standards. It is specified that all rights and matters are governed by Italian law.
